Personal Injury - Bicycle Accidents

New Jersey Bicycle Accident Lawyers
Bicycle Accident Attorneys in New Jersey

The popularity of bicycling has increased dramatically over the past three decades. Bicycles are now used by many New Jersey as their main mode of transportation. Congested roadways, the high cost of commuting and parking restrictions make bicycling a convenient and inexpensive alternative.

Many cities have constructed special bike lanes and many parks have now made trails accessible to bicycles. Even some vehicle manufacturers are now offering bike racks as standard equipment. However, many automobile drivers do not respect the bicyclists' rights to share the roads and, more importantly, young bike riders haven't been educated on how to legally and safely share the roads with automobiles, resulting in a rise in serious, and sometimes fatal, injuries to bicyclists.

In the United States, a bicyclist is fatally injured every 6 hours and nearly one million children are injured every year in bicycle related accidents. While collisions with automobiles only account for 1/3 of the accidents, they account for the majority of the catastrophic injuries, 75% of which are head injuries.

Motor vehicle operators and bicyclists must obey the same traffic laws and there are many "new" traffic laws concerning bicycles. These laws also include the requirement that bicycle safety helmets be worn by minors.

Additionally, under New Jersey law, a bicycle rider is considered a pedestrian for insurance purposes. Therefore, if you are injured by an automobile while operating a bicycle, you may be entitled to have your medical bills paid by your automobile insurance company. Under New Jersey’s “no-fault” statute, your automobile insurance company is generally responsible for the payment of the medical bills regardless of fault. However, in order to establish a medical claim with your automobile insurance company, you must promptly notify the company of the accident and complete necessary paperwork. If this is not done, claim may be denied.

While proving a physical, emotional, or cognitive injury can be difficult, our experienced and knowledgeable attorneys and staff are able to undertake difficult cases and prevail, convincing skeptics of the merits of a claim via credible, trustworthy evidence and objective test findings. Aiello, Harris, Devero, Marth & Schiffman is committed to protecting our client's rights and has repeatedly demonstrated our ability to succeed in the most challenging and complex bicycle injury cases.
